Florida maintains a unique system of car insurance and compensation after a crash called a no-fault system. Under a no-fault system, drivers are required to carry personal injury protection (PIP) coverage and, when a crash occurs, they must file a claim under their PIP coverage with their own insurance company first. In fact, they are barred from filing a claim against the other driver unless their injuries exceed the serious injury threshold. This is true regardless of fault.
For drivers who aren’t in serious accidents, this can be advantageous – for example, even if you’re at fault for an accident or the at-fault driver doesn’t have insurance, you can still file a claim for damages against your own insurance and recover compensation. Of course, limits on PIP coverage are low, and for serious injury cases, stepping outside of the no-fault system is often necessary.

In filing a lawsuit, a plaintiff will need to prove that the defendant owed them a duty of care, that the duty of care was breached, and that the breach was the proximate cause of harm in addition to proving that damages were suffered.
